A legal analysis by staff for the Arizona Corporation Commission believes a bill that would require the commission to seek legislative approval for its policies would be unconstitutional.
The opinion, from Janice Alward, chief counsel for the ACC, states that House Bill 2789 is unconstitutional as currently drafted because it undercuts the commission’s constitutional authority amid various legal precedents.
